About Indian Law

The method of laws operating in India is known as Indian laws. The provisions of Indian laws are largely predisposed by the antique texts, the Arthashastra (400BC) and the Manusmriti (100AD). Certain chucks are also drawn from the English common code and the laws of western countries.
An important source of Indian laws is the Indian Constitution and rules issued by the legislative bodies. The Indian President and State Governors also possess powers to issue regulation. Verdicts passed by the Supreme Court, High Courts and Specialized Tribunals also form an important source of Indian legislature. Certain international trade laws, such as the laws on intellectual property, are applicable in India.

Key Branches of Indian Laws

The complex system of Indian laws is aimed at pledging justice and equivalence to all Indian citizens. They also intend to promote a democratic and liberal society in India. Main branches of Indian legislation include:

Administrative Lawyer

Administrative laws form an integral part of the public legislation. It regulates the working of government agencies involved in the decision-making process and administrative activities, such as formulation and enforcement of rules and regulations. These government agencies include commissions, boards and tribunals.

Family Lawyers

Family laws are a branch of Indian laws that are applicable on a person by feature of his religion. The three main branches of family laws are Hindu laws, Christian laws and Muslim laws. Family laws govern litigation related to personal matters, such as marriage, divorce, guardianship, adoption and inheritance.

Criminal Attorney

Criminal laws in India describe types of criminal offences and punishments for committing those offences. An important legislation governing criminal offences in India is the Indian Penal Code (IPC). It applies to the whole of India, including the State of Jammu and Kashmir.

Civil Advocate

The primary aim of Civil laws in India is to deal with non-criminal disputes, such as the formation and breach of contracts, ownership of property and issues of child keeping. What Does a Civil Lawyer Do?

Lawyers For Civil Law
A lawyer who specializes in civil law is known as a civil lawyer. Civil law has a lot of fields as well as business laws, corporate laws, intellectual property laws, family laws, personal injury laws, probate laws, real estate laws, tax laws, etc. Civil law is a division of law commerce with disputes between individuals and/or organizations, in which reimburse may be awarded to the casualty. A civil lawyer not only represents the client in a legal taking place but also provides legal advice to the client in civil transactions.

Civil law comprehends all law that is not criminal law. Civil law seeks to resolve non-criminal disputes such as disagreements over the meaning of contracts, property ownership, divorce, child custody, and compensation for personal and property damage. Civil lawyers handle lawsuits that involve individuals, businesses, and even the government.

Civil lawyers will generally choose one or more areas of law to specialize in. If you need support with tax laws, you should go to a civil lawyer who specializes in tax laws. If you have been wounded in an accident and you want to file a law suit looking for damages, you will need the services of a civil lawyer specializing in personal injury lawsuits. If you are filing for divorce or seeking custody of your child, a civil lawyer specializing in family law will be able to help you out.

A lawyer can also help you if you are running a business by giving you timely advice that can save you from costly civil law litigation. A civil lawyer specializing in business laws can give advice you on the system your business needs to fulfill and the licenses required by your business. He can even help you obtain the licenses. Laws regulating the performance of corporations are complex. There are civil lawyers who specialize in corporate laws. In a real estate transaction, a lawyer specializing in real estate laws can make sure that the transaction is being conducted in the proper way, the essential documents are properly executed and the sale proceeds properly paid out and accounted for at closing.

There are no special qualifications for becoming a civil lawyer. Like all lawyers, they must have a JD and LLM Degrees from an Indian Bar Association recognized law school and must have cleared the state bar exam. Before a lawyer can practice in a state, he must pass the state bar exam.

How to Be a Good Corporate Lawyer

Standard lawyers flourish, good lawyers are common, but great corporate lawyers are hard to find. What is the mantra that makes a good lawyer GREAT and GOOD? Great lawyers love what they do and it is this passion towards their work that separates them from unevenness.

Step 1=> Know your subject & law carefully. In-depth and sound understanding of the substantive law is a must. Know your subject, its nuances, interpretations and important case laws to have a command on the law that you are practicing. No amount of communication or writing skills can gloss over the lack of knowledge in law which comes from continuous reading & practice. Repetitive reading of law with an open mind brings different connotations and opens the door for creative interpretations. I have personally read same clause differently at different times which new outlook each time.

Step 2=> Know the facts crusty & clear. Complete understanding of the facts of the transaction helps accurate application of law as law applies differently to different facts. No two matters are similar so grasp the facts correctly to charge an issue. Delusion of a fact may change the whole structure and the end result sought to be achieved. My senior and mentor in law Mrs. Pooja Jha had the ability to get to the core of the matter by vertical power of crispy reading and simplicity of thought. I continuously strive for that clarity.

Step 3=> Understand the purpose required to be achieved. Empathize with the needs of your client, dynamics of the transaction and what is future to be achieved. Alignment with the objectives of your client coupled with certain analytical & appraisal skills helps in gaining long lasting confidence of the client. One possible way of gaining this insight is by having a serious need to know your client's business and by feeling the passion he/she feels for the issue.

Step 4=> Know your atmosphere. Make a aware attempt to read new developments in the practice area that you are specializing in; understand its dynamics, rules and regulations, latest amendments and changes in law and the transactions closed in the sector. This will help in gaining the self-assurance of the client and also structuring the transaction better. Client's prospect from a good corporate lawyer is usually a mix of good legal understanding and sound commercial appraisal/suggestion.

Step 5=> Keep the Right manner. It is the attitude that separates patchiness from greatness in any profession. Sincerely loving the work that you do makes all the dissimilarity to the advice given. Believing in the work one does and the clients one represents is important to ignite that all so important obsession - so therefore do not accept briefs that you not go well with your own belief system. There are times when I refuse briefs/transactions that require me to render advice or undertake work that goes basically against my worth system. Corroboration of one's obligation towards work and aiming for the fulfillment of the client also helps.

Step 6=> Focus on interpersonal relationship and be available when it matters the most. Learn to listen (and not only hear) to the viewpoint of not only your clients but also your opponents, support team, and other connections. Watch closely how they think and what makes them happy - stroke their achievements. Being perceptive and point of view is one of the toughest parts of being a great lawyer and being available for most part of the day is the other. However, ease of access brings trust and steadfastness - so go for it.

In my experience as a corporate lawyer, the single principal inspiring factor that keeps me going is my fervor for work, approval of my clients and the pure happiness it gives me. There are no classes that one can attend to become a great lawyer - what ultimately counts are the way we move toward our profession and I still have miles to go...
